Constitutional Question; Federal vs Provincial Governance
There is an interesting aviation related Constitutional question being asked through the Courts.
The scenario is as follows.
1. Aviation and aerodromes are regulated federally through the Aeronautics Act
2. A private aerodrome operator leases privately owned land by signing a lease agreement under the guidelines of the Province.
3. The operator follows both federal and provincial regulations where applicable, and pays provincial taxes on the leased land for several decades.
4. Due to Provincial regulations the term of lease is about to expire and is now being re-negotiated.
5. The aerodrome operator then challenges the Provincial regulations and provokes the Constitutional question, does the Provincial Planning Act even apply to a Federally regulated aerodrome?
Is this a frivolousness waste of the court’s time and people’s money, including the taxpayer who funds round after round of Constitutional questions concerning Federal vs Provincial governance of aviation affairs. Or is it just me?
