CARs 602.13 (2)b interpretation

CARs 603.13 (2) states in full

(2) A person may conduct a take-off or landing in an air-
craft within a built-up area of a city or town at a place
that is not located at an airport, heliport or a military
aerodrome where
(a) the place is not set apart for the operation of air-
craft;
(b) the flight is conducted without creating a hazard
to persons or property on the surface; and
(c) the aircraft is operated
(i) for the purpose of a police operation that is con-
ducted in the service of a police authority, or
(ii) for the purpose of saving human life.




I was wondering what constitutes creating a hazard in terms of a paramotor.

If I were landing on a field and on final my engine died but I can still glide away from the highway that's under final and into near by trees. Is that creating a hazard?

If I were to take off or land and I end up being slammed into a building by a rouge gust of wind and break a window but other than that it's obvious that given my weight and speed I'm not really going to do damage to building.

TL;dr I interpret Hazzard as creating a scenario where I may cause major damage or injury to a person.

I think you missed this part, the "and" being the key word

"...and
(c) the aircraft is operated
(i) for the purpose of a police operation that is con-
ducted in the service of a police authority, or
(ii) for the purpose of saving human life.

So unless you are a cop or medevac, it doesn't apply.

If you are landing in a field, you are most likely not landing in a built up area or in a city and thus that rule does not apply. In a field you can generally land if you have permission of the owner.

Your contingency is covered under 602.12, not 602.13, because you don’t meet the “saving human life” clause of 602.13.
