703/704 Operating Certificates

Hi guys

Just a question, can a 703 or 704 Operation be bought by someone else as long as the post holders are approved by TC the entity that holds the Operating Certificate can be sold, correct?

A company can be sold and the AOC can be transferred with it. TC has requirements and a process to follow for changes to approved positions (ops manager, chief pilot, PRM). If none of those change, the only thing they need is an update of the company name and contact information for the principal owner.

Onex bought the shares in Westjet. The only regulatory consideration was the Canadian ownership content of Onex shares, assuming they had 100% of Westjet.

I know the point you're making, but the shares in a company that holds an AOC can be sold, as long at the Canadian ownership ratio remains within the minimums.

I'm sure you know that distinction and you're right, you can't sell airplanes and the AOC in a package. Used to be able to, but not anymore.

As said above though, as long as TC approves the transition, you can still essentially "buy" an operation.

So how does it work if a company leases everything, hangar and planes etc? Really the only asset that's left is the AOC and I guess the staff, but they are really just rented. I flew for a Company that as far as I could figure all they owned was the AOC and the coffee machine in the office, I think the desks werent even theirs.

i would encourage you to read the CARs and other documentation on how to start a commercial airline as it explains everything and you can lease hangers and aircraft etc
