I do quite a lot of flying in the US, but I don't know the answer to this question.

As PIC in a Canadian registered plane, which rule are we bound by for currency to take passengers?

If it's 5 in 6 months, and somebody has a mishap, FAA would be involved. Let's say the 5 takeoffs and landings were done 5 months prior to, the Americans would think currency is not valid as they are used to the 3 in 3 months. And even if FAA knows there's a difference, I'm sure there would be people on the field (ATC, airport managers, etc) who wouldn't and would come to the wrong conclusion. Worst if there are American passengers involved - lawsuits, etc.

If it's 3 in 3 months (which I doubt), then a lot of Canadian GA pilots would likely not be aware and would get in trouble.

I would think that flying a Canadian registered aircraft with a Canadian pilot's license that you would follow the Canadian currency requirements.

14 CFR 61.57(b)(1):
(1) Except as provided in paragraph (e) of this section, no person may act as pilot in command of an aircraft carrying passengers during the period beginning 1 hour after sunset and ending 1 hour before sunrise, unless within the preceding 90 days that person has made at least three takeoffs and three landings to a full stop during the period beginning 1 hour after sunset and ending 1 hour before sunrise, and -
...

But 14 CFR 61.2 provides that...

(b)Currency. No person may:
(1) Exercise privileges of an airman certificate, rating, endorsement, or authorization issued under this part unless that person meets the appropriate airman and medical recency requirements of this part, specific to the operation or activity.
(2) Exercise privileges of a foreign pilot license within the United States to conduct an operation described in § 61.3(b), unless that person meets the appropriate airman and medical recency requirements of the country that issued the license, specific to the operation.

61.3(b) referred to in 61.2 reads
(b)Required pilot certificate for operating a foreign-registered aircraft within the United States. No person may serve as a required pilot flight crewmember of a civil aircraft of foreign registry within the United States, unless -
(1) That person's pilot certificate or document issued under § 61.29(e) is in that person's physical possession or readily accessible in the aircraft when exercising the privileges of that pilot certificate; and
(2) Has been issued in accordance with this part, or has been issued or validated by the country in which the aircraft is registered.

Which, all in all, means that Canadian recency rules apply when using a Canadian pilot licence to pilot a Canadian aircraft in the US.

Flying out of country rule of thumb is you adhere to the most restrictive rule. If home rules are more restrictive then that is what you adhere to if the away rules are more restrictive then that's what you play by. Then your ass is always covered.

Thanks for the responses. It does make sense to adhere to the stricter rules - in this case the US ones. It's a little bit of a PITA though especially with the night currency.
