The key words there being common law.Many companies anticipate that their employees are largely unaware of these rights, whether under a provincial Employment Standards Act (ESA) or common law.

Yes there are 2 sides to having your employment terminated, employment standards act & common law. ESA dictates bare (& pathetic) minimums, but under common law you could be eligible for 2-4 weeks of severance per YEAR of employment. There are many factors that could play into this amount. Also keep in mind, under common law you could be subject to claw backs if you find a job, or can't prove you are looking for one. Some companies with deep employment contacts limit their exposure in carefully worded details.

We're all federal employees, so the Canada Labour Code and common law prevail, not Ontario's law or otherwise. Employees with union contracts are not likely owed anything outside of their contract provisions, and generally temporary layoffs are authorized in the CBA.
Non union employees generally have more rights in terms of severance for constructive dismissal during a temporary layoff.
The real question is, do you want to sue your employer that's given you the grace of a guaranteed callback considering how impossible it is to find a new flying job?

Howard Levitt from the National Post has written good articles on this subject. It's required reading if your work situation has changed.

If you were a lawyer who could only command $60 an hour, then yes, I would have some serious concerns about hiring you.

So if you are BC or ON based, and your employer has said that your layoff is permanent then you may be entitled to something.
Pilot layoffs are not permanent though. At least none that I've heard of. WS pilots have right of recall for 10 years, not sure what the other companies have but I'd guess all the ALPA ones have the same 10 years.
