2. Subsection 6-4.03 shall be deleted and replaced with:
.03 The Company may construct Pairings that transions the midnight hour from one
Day to the next Day provided that the scheduled Release Time occurs no later
than 01:00 on the second Day. These Pairings will be in accordance with the
maximum allowable Flight Duty Period in Subsection 5-3.01.
a. On a single Day Pairing, in order to transition the midnight hour from one
Day to the next Day, the Duty Period must have a Report Time no earlier
than 11:00 on the first of two (2) consecutive Days and must have a
Release Time no later than 01:00 on the second Day.
EXAMPLE: A Pilot may be assigned a Pairing scheduled to Report at 13:00.
This Pilot must be Released no later than 01:00 on Day 2.
b. On a Multi-Day Pairing:
i. On a multi-day Pairing, the last Duty Period must be scheduled to
have a Release Time no later than 01:00 on the Day following the
end of the Pairing.
EXAMPLE: A Pilot is assigned a 3-Day Pairing – On Day 1 and Day 2
of the Pairing a Pilot will be scheduled Rest consistent with
Section 5-5.01. On Day 3 the Pairing has a Report Time of 14:00 in
which case that Pairing must Release no later than 01:00 on Day 4.
c. A Scheduled Subsequent Duty Period on the Same Day:
i. The Company may schedule a Pilot to operate a separate Pairing
on the same Day as the 01:00 Release Time, as per Subsections 6-
4.03 a. and b., above, provided the CARs and Collective
Agreement are observed.
EXAMPLE: A Pairing is scheduled with a Release Time of 00:45. A
Pilot may be scheduled to Report for their next Pairing on that
same Day, no earlier than 12:45 or as required if actual operations
result in a Release Time for the Pilot later than 00:45, in
accordance with the Rest requirements of Subsection 5-5.
d. The pilot will be paid and credited in accordance with Section 3. Duty
time that transitions between 00:00 and 01:00 is considered the same
(single) Duty Period for Pay and Credit and will not incur a second MDPC
for the transition into the second Day.
