Sometimes it is better to just apologize rather then doubling down when called out on something. I have a feeling a large part of this was the attempt to play it off as a legit request that was misinterpreted. I don't think we need to fire everyone who tells a manager to F themselves but you probably need to at least apologize and agree to express yourself better in the future or you put them a tough situation of losing face or forcing actual discipline.

I think it's important to note they didn't directly send the email to the manager who was offended. Fried chicken and watermelon is one of my favorite meals so it's disturbing that my race could cost me my career if another person catches wind that I ordered it.

This guy knew exactly what he was doing and what he said. Saying sorry is appreciated, but it doesn't relieve you of the consequences that follow. Tough lesson to learn.

Did you read the decision? The arbitrator determined that it wasn't a legitimate request for a number of reasons.
I spoke with a guy today who knew him since flight school. Apparently, the guy always rode the line. This time he stepped over.

If he was making an illegitimate request, was it just a stupid order without understanding of the connotation? It missed the racist mark by adding the Bud light. That in fact offsets the fried chicken order.
And if he did understand the connotation I don't believe it was directed at anyone other than himself, as that's who the order was for.
Also, the fact is that fried chicken and watermelon is delicious. Why shouldn't a white man enjoy that and wash it down? Why does everything have to be about race? What if he didn't order the watermelon? What if he ordered chow mein and green tea? What if he ordered sushi and sake? What if he ordered BBQ and a pack Marlboro reds? Who gives a shit. Get this man his dinner...
The thing that also gets completely missed is that the employer was in violation of the collective agreement which provoked this whole situation. Why were they so resistant to allow him to expense a $10 cab ride to fulfill his requirement to access to services?
And arbitrator reasons... like not following up on his order? not bringing his friend into it as a witness? Weak.
There's no way that someone should get their career washed down the toilet for this. If he "walked the line" why wasn't previous discipline entered as evidence?

I am curious though, if the captain wanted to fight this based on the "it wouldn't have been a problem if i was black", would he still be able to in a court of law? Or did he give up that right when agreeing to arbitration? Or is arbitration the first step because it's part of the collective agreement?

He didn’t order anything, he knew full well at 1 am, no food was coming, however, I agree, he should not be losing his career over this.

She freaked out and there was great worry about whether this would go further or not. I swallowed my pride and apologized to this ditz of a bimbo but was prepared to fully discuss things with management that she had said in my presence if need be. Yes, she was a ditz(in look and personality) yet apparently became some sort of peace officer up north.
Be careful who you associate with. There is no shortage of people that are unreasonable and we live in an era where maximum punishment for a joke after a few drinks will gladly be meted out. It ain’t worth your career taking a chance.
I suspect that in the Sunwing case, the guy was not actually asking for a legitimate order. A suspension for a month would have been reasonable.

The captain decided to help himself and she later wrote him up because apparently youre not allowed to help yourself to them, even though she offered.
