Fly & Hunt
Can anyone tell me if it is legal to fly-in and hunt the same day here in Ontario. I know it is legal in Quebec & Nunavik but is not in Alaksa, Yukon, MacKenzie Mountains (NWT), not sure about Nunavut but think so. I guess out of curiousity what's the rule where you are and in paticular, Ontario? Also, I guess we better qualify it as being fixed vs. rotory. Thanks, sheephunter

Legal. Just don't use the aircraft to spot or you'll be in court trying to get it back.

I don't know about the big O, but in the Yukon you can shoot six hours after flying in. If the purpose of the flight is for spotting then you have to wait 48 hours before shooting.

From The Fish and Wildlife Conservation Act
Aircraft
(3) A person shall not use an aircraft while hunting.
“hunting” includes,
(a) lying in wait for, searching for, being on the trail of, pursuing, chasing or shooting at wildlife, whether or not the wildlife is killed, injured, captured or harassed, or
(b) capturing or harassing wildlife,
except that “hunting” does not include,
(c) trapping, or
(d) lying in wait for, searching for, being on the trail of or pursuing wildlife for a purpose other than attempting to kill, injure, capture or harass it, unless the wildlife is killed, injured, captured or harassed as a result,
and “hunt” and “hunter” have corresponding meanings; (“chasse”, “chasser”, “chasseur”)
There are no O regs that prohibit the use of aircraft fixed or rotary to access a hunting area and no timeframes , however the Ontario CO's agressivly persue any one who is suspected of using an aircraft to spot moose .. Which will result in an aircract siezure for a time and hefty legal fees wether the acused wins or loses .

From yukon game regs
hunt big game within six hours of arriving at a hunt camp by aircraft other than a
commercial aircraft on a regularly scheduled flight from one airport to another.
fairly sure a CO could make a case that tincup lake or wherever is not an airport.

Nunavut has a 12 hr hunt ban from fly time. We'd move our guys in the evening to spike camps and be legal by morning.

Everyone, thanks for your replies. The Nunavut one is interesting and didn't realize they had a 12 hour, Yukon, didn't know it was only six hours but beleive and could be wrong that there is absolutely zero rotory tolerance? I thought that there was nothing for Ontario, but I plan to fly up north (not really north) but anyway was going to fly up in 2 hours instead of driving 3 on paved, 3 on dirt and one in a boat and hopefully hunt the same day. I will ultimately check with the CO's first. Still some provinces missing that I am just curious about. Thanks, sheephunter.

In BC, 6 hours for chartered flights, same as Yukon. In BC, there is ABSOLUTELY, POSITIVELY, ABSOLUTELY no use of helicopters permitted for hunting, spotting for the purpose of hunting, moving supplies for the purpose of hunting, transporting hunters....well you get the idea.
