getting out of an appartment lease?

getting out of an appartment lease?

I am in ontario now and just got a job in another province. Is there a way to get out of a 1 year lease without having to pay the penalty . ? The penalty is one month rent plus 500 $ ? Anybody been in this situation before ? I told the rental company that i might be leaving early, and the lady i dealt with said it would be no problem. Of course , that lady is no longer working here and stupid me did not get this in writing. I know that if i find somebody to take over the lease its fine but i am pressed for time and don't think i can do that ? anybody know ?

No problem. Is there a butcher shop near you-you need some animal bones for this to work. You also need to buy an old beater fifty dollar car , a railroad track,( find out when the night freight goes through though-saves time waiting in your beater car ), five gallons of gas, bic lighter, and you need to write a fake suicide note.

Try to get your new name off a Quebec graveyard-their records are the worst.

I'd chalk it up to a learning lesson, bite the bullet and pay the fee. Hurts the wallet more for sure, but it's probably easier than looking for a loophole.

sometimes there is a moving clause, if not and the land lord is a dick, throw yourself an eviction party.

just check with the super. Sometimes if there is a waiting list for units they will let you out of the penalty, happenend to me a few years ago.

So you agreed to something and now decide you don't want it any more, but don't want to follow the agreement? Find another tenant, or pay the money. That's what responsible people do, and you are responsible, right?

If you paid first and last month when you moved in, you're probably alright. You could probably just hit the road. You will not get your damage deposit back, if there was one. The apartment folks wont chase you for money into another Province, and there is no national "renter maggot" list. I'd be inclined to just go ahead and move. But, be a gentleman about it and leave the place nice and clean.

Pay the bill I just lost my job and I am going to return to Ontario from Alberta and going to pay 4 months rent to get out of my lease.

Best way is always to find somebody else to occupy your appartment. All it costs is a bit of effort, maybe some advertising.
I'm in such a situation right now. Got a nice little spot in the Laurentians near CYMX if anybody is interested.

Not true. It's very cheap ($100 I think) and easy for the landlord to file a civil claim in the provincial court of the city where you were renting. Then it's up to YOU to come back to the province to defend yourself.

Best solution is to [1] discuss with the landlord and [2] help them find another tenant.

Or you can ask to be let out of the lease.

If that does not work go and hire for the day a group of inner city kids with lots of tattoos and face piercings playing loud music to sit in a car. Have them park in front of the leasing office. Tell your landlord that if you can't get out of the lease that those kids agreed to sublease the apartment from you for the rest of the year and would like to know where they can park their motorcycles?

A buddy of mine did that and he was let out of the lease. He just lost the last months rent. :mrgreen:

4 Months thats crazy, I'd have a look at the Alberta Landlord/Tenant Act before you cut em a check for more than last month and a lease break fee.

I could be wrong, but I think they can charge you the entire rent for the rest of the lease until they get a new tenant. So in theory they could probably just not bother looking for a new tenant, and make you pay until the end of the lease.

I was in this situation 2 years ago - we had to move out of Calgary because of a new job, but our lease had 6 months remaining. We helped our landlord find a new tenant and she agreed to waive the penalty. She then tried to withhold our deposit anyway and we had to file a civil claim to get it back. In the end we settled before going to court.

I never signed a bond in my life , and i have probably in aviation a lot longer than you have . This is way off topic....


The reason i wanted to find out my options is because i was mislead . Like i said it was my own stupidity , not getting this in writing when i was promised, i would not have to pay . I told them when i rented the place that i had a job interview , and i might only stay for 4 month ...... I was told in that case i would not be held responsible . As i see now this is not true and un honest people really get to me , I am a person of my word , when when somebody misleads me in order to get a commission i don't really feel obliged ......

Anyways thanks for all the replies . As it looks i might have to cough up the extra month rent on top of my last month rent plus a 500 $ . Steep , but a lesson learned....

Remember that sub-leases normally have to be agreed on by the landlord...

A few others, if he won't let you out, and there is no way out of paying:
  • 1. when you leave, turn all the taps on full, and leave them running, including the hot water. No plugs of course; you don't want to flood the place and get sued.
    2. ...except one of the sinks: place 2 mackerel in there and turn the heat up high (if you put them on the floor, you might be sued for costs; won't happen if you leave them in the sink).
    3. turn on all the lights, and plug in a baseboard heater and run it at max.
    4. turn the fridge to "coldest" and leave the door ajar.
    5. Don't leave the windows open so rain or snow can get in. Besides, you want the full benefit of the mackerel.

Why dont you act like a profesional, and HONOR your commitments?

Folks, when the aviaiton community wonders why wages are low etc, its BS like this that keeps things in the shitter.

Good news here is your moving to a new province for work, I assume.

Breaking your lease is a moving expense, which of course are tax deductible.

Write it off and get drunk for a few weeks 8)
