commercial vs private schedule???

I just want to have some thoughts on this one. There is a company that operates 5 planes and only one of them is on a commercial schedule. I wont say the name or what they do, but it is a seasonal job and they fly around 500 hrs in 4-5 months. I will say that I think they should be on a commmercial sched, but legally, when an airplane is used to make money, don't they by law need to be commercially registered with a comm. sched?? TC audit the company every year and yet they don't seem to care, or can some operators (like aerial photography) that are not required to have an OC, can operate privately??

No they do photography, I know that they do not require an OC tho they do have one, but I was curious to know how can only one of their planes be commercially registered and the other ones private. A friend of mine is nervous about the maintenance or lack of it for the number of hours they put in a season. I guess I just answered my own question, if they don't need an OC, maybe not all of the planes need to be comm. registered.
