Shall we propose an alcohol ban against drivers over age 60? Clearly, rules that are applied to people differently on the basis of age are contentious.
What about though, if there were a labour group that, as a condition of employment, was bound by a policy that had an alcohol related restriction that was more restrictive than what the law required? Would it be possible to challenge that as a charter right; the 'right' to drink up to 8 hrs prior to operating a flight instead of the 12 hrs that is Air Canada policy? Complying with this condition is mandatory, and yet it is 50% more restrictive than the law. Are my rights being infringed upon?! Or is this just something that I accept as part-and-parcel of being an employee of Air Canada and a member of ACPA?

The problem is there is no real money behind it! Human rights as airline pilots go, only count when money is involved. The seniority system, wearing a uniform, even telling us what plane we are going to fly is SOME sort of discrimination. Then again, we accept it when we sign up. My freedom of expression is being hindered making me wear a uniform. Why am I forced to follow a seniority system? I have flown a big jet before, I want to fly the same one now, isn't that discrimination on some level?
But any lawyer worth his salt with a money bag tied around his neck, or jowls as it were, will only fight the discrimination faced by certain groups. Regardless of the cost to others.
A noble fight indeed. Help the senior who gets 4x the pay of a "junior" to do 1/4 the work.
I could only wish more people in the world saw it this way. To compare our retirees to workers making minimum wage, having to work more years to be comfortable. I'll make sure to pass the msg along to the next 65yr old walmart greeter that AC seniors are right there with you. I'll just leave out the part where they will make in a month what you make in a year, that may just annoy him. Go figure.

Not correct. It counts when pilots are prevented from working on any of the prohibited grounds of discrimination as outlined in the legal system of Canada.
Wear shorts. As long as it's the same material and color, why would it be a problem. There are long and short sleeve shirts. You should apply to the Human Rights Commission to make the forced wearing of long pants one of the prohibited grounds of discrimination in Canada. Which is different than the way it was when the guys before that signed on.Because you knew that's the way it was when you signed on.
Only if you want to fly the big jet but you're not allowed to because you're wearing shorts.
