Vacation and Stat Holidays for Pilots

I'm wondering what the norm is for companies regarding vacation and stat days for pilots working on a continuous operation. From what I've seen, most airlines give on average two weeks vacation to start, plus 9 stat days whether or not they are worked. However, the airline I presently fly for does not give stat days, only time and a half if a particular stat day is worked.

I would think that airlines would not give the 9 stat days unless they had to, but that begs the question as to why we don't get it where I presently work. I'm not a labour lawyer, just looking for some input.

30 days annual paid leave, 10 paid sick days, and a round trip ticket for my dependants and I per annum... No Stat hollidays although the company shuts down for Christmas and New year's day...

9 stat days and two weeks holiday... but we work a set rotation. The aircraft is crewed 24/7 including Christmas and new years

You are entitled to 2 weeks holidays, 3 weeks after 6 years, in addition to 9 days for stat holidays.
Cargojet didn't pay their pilots stat holidays for a time. A pilot used the " open door " policy they had to bring up the issue. He was threatened with his job, and the " open door " policy became known as the " trap door " policy.

Anyway, here is the labour code section that applies to holiday pay. Hope this helps.



198. An employee employed in a continuous operation who is required to work on a day on which the employee is entitled under this Division to a holiday with pay

(a) shall be paid, in addition to his regular rate of wages for that day, at a rate at least equal to one and one-half times his regular rate of wages for the time that the employee worked on that day;

(b) shall be given a holiday and pay in accordance with section 196 at some other time, which may be by way of addition to his annual vacation or granted as a holiday with pay at a time convenient to both the employee and the employer; or

(c) shall, where a collective agreement that is binding on the employer and the employee so provides, be paid in accordance with section 196 for the first day on which the employee does not work after that day.

Thanks for the replies, that's very helpful so far. Where it isn't clear to me right now is that the language states that you get a day off in lieu if you work a holiday. However, it seems as though many pilots are getting 9 stat days regardless if they work on the stat holidays or not. I'll need to research that part a bit further.

They are on days off on the stat holiday. Once the company gives you 9 stat days to be used when you want, you have to use a day off to actually get the stat holiday free from flying.

You get your 2 weeks, and 9 stat days. Then you get X amount of days off each month.

So, if you put your vacation and stat holidays all together and take, say August off, then you want Christmas off, you can use your day off for that month to have Christmas off. By the labour code, if a holiday falls on a day off, then your are entitled to another day off to be taken later, which you have been compensated for by the company giving you 9 stat holidays.



193. (1) Except as otherwise provided by this Division and subject to subsection (2), when a general holiday falls on a day that is a non-working day for an employee, the employee is entitled to and shall be granted a holiday with pay at some other time, which may be by way of addition to his annual vacation or granted as a holiday with pay at a time convenient to both the employee and the employer.

Just a quick related question. Can a company force you to take vacation, I read the 180s section of the labour code and it doesn't appear to be in there as to whether or not a company can force you to take it.

By force, I mean, can they deduct half a day of vacation because you only worked a half shift that day?

A company may force you to take holidays. They must, however, give you two weeks price and it must be a minimum of three days at a time.
