CARS 604 duty rest

Can anyone provide a link to Transport Canada's website that indicates the minimum crew rest within a 24hr period for private operators? Can't find a thing on that confusing site.

Flight Duty Time Limitations and Rest Periods

604.27 (1) Subject to Sections 604.28 to 604.30, no private operator shall assign a flight crew member for flight duty time, and no flight crew member shall accept such an assignment, if the flight crew member s flight duty time will, as a result, exceed

(a) 14 consecutive hours in any 24 consecutive hours; or

(b) 15 consecutive hours in any 24 consecutive hours, where

(i) the flight crew member's total flight time in the previous 30 consecutive days does not exceed 70 hours, or

(ii) the rest period prior to the flight is at least 24 hours.

(2) A private operator shall ensure that, prior to any flight duty period, a flight crew member is provided with the minimum rest period plus any additional rest period required by this Division.

(3) A flight crew member shall use the rest periods referred to in subsection (2) to obtain the necessary rest and shall be adequately rested prior to reporting for flight duty.

Is there an "8 hr" rest requirement, or just an ambiguous requirement to be "rested"?

I didn't see anything there but it does imply 10hrs free from duty is required.

The last bit of 604 that pertains to rest is:
Split Flight Duty Time
604.28 (1) Where flight duty time includes a rest period, flight duty time may be extended beyond the maximum flight duty time referred to in subsection 604.27(1) by one-half the length of the rest period, to a maximum of 4 hours, if

(a) the private operator provides the flight crew member with advance notice of the extension of flight duty time; and

(b) the private operator provides the flight crew member with a rest period of at least 4 consecutive hours in suitable accommodation.

(2) The minimum rest period following flight duty time referred to in subsection (1) shall be increased by an amount at least equal to the extension to the flight duty time.

Extension of Flight Duty Time

604.29 Flight duty time may be extended beyond the maximum flight duty time referred to in subsection 604.27(1) if

(a) the extension of flight duty time is authorized in the private operator certificate; and

(b) the private operator and the flight crew member comply with the Private Operator Passenger Transportation Standards.

Unforeseen Operational Circumstances

604.30 Flight duty time may be extended beyond the maximum flight duty times referred to in subsections 604.27(1) and 604.28(1) if

(a) the pilot-in-command, after consultation with the other flight crew members, considers it safe to do so;

(b) the flight duty time is extended as a result of unforeseen operational circumstances; and

(c) the private operator and the pilot-in-command comply with the Private Operator Passenger Transportation Standards.

Delayed Reporting Time

604.31 Where a flight crew member is notified of a delay in reporting time within the two hours preceding that reporting time and the delay is in excess of three hours, the flight crew member's flight duty time starts three hours after the original reporting time.

Requirements for Time Free from Duty

604.32 A private operator shall provide each flight crew member with the following time free from duty:

(a) at least one period of 36 consecutive hours within each 7 consecutive days; or

(b) at least one period of 3 consecutive calendar days within each 17 consecutive days.

Flight Crew Positioning

604.33 Where a flight crew member is required by a private operator to travel for the purpose of positioning after the completion of flight duty time, the private operator shall provide the flight crew member with an additional rest period at least equal to one-half the time spent travelling that is in excess of the flight crew member's maximum flight duty time.
I don't read anything in there re: requiring 8hrs prone.

From CAR 101.01 (Interpretations)

"minimum rest period" - means a period during which a flight crew member is free from all duties, is not interrupted by the air operator or private operator, and is provided with an opportunity to obtain not less than eight consecutive hours of sleep in suitable accommodation, time to travel to and from that accommodation and time for personal hygiene and meals;

Of course what you actually do with your rest period is up to you, but you're responsible for being rested prior to flight duty. If you aren't then CAR 602.02 applies.

You shouldn't be looking in the CARs for this information, you should be looking in your ops manual. Many POCs were approved for FMRS under the CBAA and don't use the CAR minimums at all.

Don't have access to the ops manual...question was for a friend.
Now that TC is providing POCs, do ops manuals that were approved under CBAA need to be re-approved by TC?

The links and information that cdnpilot77 posted are no longer valid as they were the regulatory requirements prior to the transfer of Subpart 604 to the CBAA in 2005. What about a company (604) giving pilots days off while on the road….mid trip. Ie: sitting in Scottsdale for 5 days. Legal? Common? Frowned upon? Can’t find any regs on this. Which makes me believe it’s ‘legal’ just not desirable to the pilot. Thoughts???

Legal if you are not on call, but a dick move either way.
