I am always a bit puzzled when I read scenarios or the question is posted, "well this is legal and this isnt, but the legal one is much more dangerous"

Do pilots nowadays have so little common sense that TC must actually regulate everything.
Legal it may be, but if it is not safe, you feel it beyond your expertise at that point, or feel that conditions may rapidly change (with cause..not just a well, they may).....do pilots no longer let fear and common sense hold them back?

You can sit behind a computer and scenario things to death. Instead, when you assess a situation you should be asking yourself one question..Can I safely do it. (Actually I was going to say "is it doable" but I know how that would be intrepreted by the TC Safety indocrinated.

There are always variables, unexpected things that can happen, and , of course a time frame.

Want a scenario. Pilot one. 5000 hours on type in the area over a 10 year period. Pilot two.
350 hours. 40 on type...Do you think that the same standard, providing it is legal, should apply to both pilots ?
Actually, come to think of it, seems from experience lately that most 350 hour types would same sure....

There is an easy solution to the whole debate.... if you are flying at 100AGL dial the old altimeter up 200 feet and just like that as far as anyone knows your at 300 AGL... :lol:

From reading the posts of people who've dealt with the TC I've extrapolated that the TC wouldn't let a simple altimeter setting stop them from fining you.

Just a note;

The letter posted way back states that AGL is defined as Above Ground Level, and includes water, vegetation, etc (paraphrased).

If anyone got stuck with this, here is the LEGAL (quoted directly from the CARs) definition of AGL: " "AGL" - means above ground level; (AGL) " That is the legal definition from the legal document. The letter, if the law means anything, could not be used to re-define AGL, since it contains additional information not stated in the legal definition as published in CAR 101.01.

I just thought that was noteworthy, in case anyone had to deal with a charge...
