Bandit, the rules for shooting someone dead are the same for cops as you and me. You can use deadly force to defend yourself or another person from death or grievace bodily harm. For the cops, they are only permitted to use their firearm in that circumstance, therefore when it is used, it is for the purpose of applying deadly force. If "wounding," or less than deadly force is the highest justified option, they have to use batons, tasers, fists, boots, and other weapons not likely to kill.

Ratherbeflying, police executing a warrant in the middle of the night is quite different from a home invasion. It's murder if you shoot the cops because the warrant issued by a judge gives the cops the legal right to kick your door down and enter your home. They also announce and identify themselves when they are doing it. Home invaders are criminals committing a break and enter, usually followed by other serious crimes.

It will be interesting to see how this guy makes out in this Alberta case. These cases can go either way depending on the circumstances and you can bet it will be a thorough investigation with no result for several weeks or months.

I saw this on the news tonight they said the home owner new the intruders but it made me think of this clip I saw in the news couple of months ago





CHICAGO, Oct 16, 2007 (AFP) - A parrot chirping "hello" woke his Texas owner up to find, and then shoot, a burglar in his garage Tuesday, police said.
"I guess you could call him a stool pigeon," owner Dennis Baker told the Dallas Morning News.
It was the fifth time the home, which is also used as a locksmith shop, was burglarized this month.
So when Baker woke to the sounds of Salvador, his Mexican Red-headed parrot, saying "hello, hello" he knew something was wrong.

Baker grabbed his gun and shot the burglar in his garage at about 1:30 am. The man died at hospital, police said.
"I have tools in my garage, my house and my van," Mr. Baker said. "They were coming here like they owned the place. I hate what happened, but somebody has to do what's necessary."
The bird also chirped "hello" when police arrived, Baker said.
"Sometimes he says 'hi,' but you can't get him to speak on cue," Mr. Baker said. "He has a mind of his own."
Texas has recently eased restrictions on people confronting intruders in their homes, businesses or cars. They are no longer obligated to retreat before responding with deadly force.
It's hard to tell whether this is the reason behind a recent spat of home or business owners shootings intruders, said Dallas police spokesman Sergeant Gil Cerda.
"It's hard to tell how many people know the law changed," he said in a telephone interview.
"Maybe some of these homeowners are saying enough's enough," he said, explaining that one local man recently shot and killed two burglars in a matter of weeks.
While Texans have the right to use deadly force to protect themselves and their property, each homicide is investigated and presented before a grand jury to determine if it was justified.
"I've yet to see one where they've ruled against them," Cerda said.

According to today's news the dead guy had a relative that was knocked up by the intended victim, they broke up a couple of months ago. He persuaded his pal to help him break in and teach daddy to be a lesson. Ok, obviously a lesson was learned here; don't break into somebody's bedroom with the intent to beat their ass, sometimes it backfires really badly.

It is also rumored that the stab wounds that Chris recieved were inflicted while he was trying to drag the body of his friend out of the house.

The sad part of this story is that Lance Norton will leave behind 2 beautiful children, a mother, a sister, and many others.

Again...these are just rumors however I have it from a source very close to the pregnant ex gf. I also grew up with the "3 attackers"

No not sympathy at all. I agree that Lance ( the dead guy ) had no right to be there, nor did Chris or the ex gf....but did he deserve to die for it? Simply stated that it is said by those that were out partying with the Victims roomate said that he had called and warned the guy that these three were headed out to his house. If that is such the case then is it still grounds for self defence or would that move it into a murder 1 charge as he would have had ample time to call the police instead of doing cowboy justice.

I agree that if it as said in the papers and he was unaware and attacked in his home then unfourtunate as it is, the perp got what he deserved I would do the same.

This one smells of fish. The perfect murder? Knock, knock....come in Bob. We're up in the bedroom...hehe. This one will go to court, for sure. I can't be the only one who smells a rat. At the very least, the home owner knew the attacker, and recognized him before he killed him? I'm sorry, but if someone you have a motive to "off" "breaks" into your house...it stinks! This was a frikken "set up" from the word "go"! Most "real" home invasions are between folks unknown to each other.

Doc you are completely right there is a rat...I guess knowing all people involved puts a different spin on it...it will come out and he will be convicted of murder.

This is a sad story all around, both men in the wrong for breaking into the home, but victim has ample warning and could have contacted the police, but chose not to. Even sader is that the victim knew that Lance had 2 little girls and a wife who are now left with no father. I understand defending yourself, stabbing someone 12 times is beyond self defense, he took the law into his own hands at that point and played judge, jury and executioner, he knew they were coming and was gonna take care of it himself, who sleeps with a knife under there pillow?!

Indirect, by your response I am going to assume that like me....you know more than what the news is saying. and very agreed with you Lance and Chris were most deffinetly in the wrong...as well as Angela the sister for driving these guys out there knowing what the intent was. And Rita the bar maid for loaning them her car...yes truth is out there. What is sad about all of this is that 2 little girls lost thier daddy, an unborn childs father killed it's uncle all because of it's mom. Yes sad indeed. Anxiously waiting to see how the courts handle all of this mess.

The most troubling part of this is that nothing has happened so far, still walking free meanwhile little ones are without a father and a community is divided on different sides of the fence not thinking about the people who are left behind, I hope Dan is feeling the pain that he has caused these family's as well as his own, no child should lose a parent so young over something so foolish.

If the father had been home with his 2 beautiful children and devoted wife he would still be alive. I'm sure the girlfriend thought a roll in the hay can't posssibly cause pregnancy can it? Chalk up another several million dollars cost to society at the expense of Alchohol.
