Divorce and Per Diems
Hello all,
I am an airline pilot who is currently in the process of getting separated from my wife. I'm just wanting to know if she will have access to my per diem. Is per diem a source of income that she can take half of?

From what I understand from talking with guys in your situation per diems are expenses and are expected to be spent. This is why they are not taxed as income and why they don't count as such.

It will depend on your separation agreement. If it is in there you will share, if not you won't

Teacher's comments are correct. My ex-wife was getting per diems, and they were NOT counted as income.

Why not put that question to your lawyer? I am sure the answer will be more accurate than what you might get here.

The determinant of 'income' is the aggregate of your T slips (4's, 5's, etc) or your income tax return (if filed) or notice of assessment (if received).

Ah, another case of AIDS. I went for the buyout in one shot. It cost, well, everything all at once and i had to rebuild from zilch but I was able to sever all ties and not have to worry about making too much in the future. If there's kids involved though it's just cheaper to keeper. Best of luck on your endeavours.

Per diems are paid to reimburse your expenses when away from your home base to work. The amount you get from your employer is not taxable because you used already taxed money from your regular income to get food. I used this argument when the ex-wife sued me to get part of my per diems. I won. Her lawyer was 100% sure she could pull that one off. She's the only one who made money that day. Of course, if your per diems appear on your T4 statement (it shouldn't), it's another story.

Because pilots are a-holes? But seriously, I would like to see some stats...I'm betting it's slightly higher than the average of 49.2%of marriages or whatever the current overall divorce rate is, but I doubt it's drastically higher. I stand to be proven wrong though. I suspect the pilots getting divorced are not stopping at 1-2 divorces either. I bet that rate is higher than average, multiple divorces driving up the rate.....but not to worry, it's not your fault, even if it is your 7th wife/husband

That's nothing unusual, I know of some who are beyond wife # three. One I was acquainted with was 65 yrs old and participated in bringing a kid into the world, his wife number 4 was over 40 yrs of age.
Me, I still have the wife of 35 yrs and still on my first cock.........

if "he's" smart, and a man in a Western country, he wouldn't marry at all. Not a knock on women, but the legal system. Picking a fight you can't win ain't exactly smart.

AIDS= Aviation Induced Divorce Syndrome.

Going on year 6 of wedded bliss. I would like to hear from some of the other women pilots on here on whether or not the AIDS thing has applied to them.

My mom used to think it was terrible when she'd ask me where he was on any given day and I sometimes I couldn't even remember which province... I'd be like "Whatever - he's back tonight some time... probably..."
