Transport Canada Civil Aviation Medical Question

Hello everyone,

I recently was diagnosed with obstructive sleep apnea (OSA). I received a letter from transport Canada basically stating:

-I have to submit a CPAP compliance report and the report stating my diagnosis before or during my next medical (in about 5-6 months from now)

-tells me to “keep in mind” that CARs 404.06 applies to my case.

Nowhere does it explicitly state my medical has been suspended or anything. The letter says that they attached that section of the CARs but they did not. It literally doesn’t say anything more than this. I’m having trouble getting a hold of transport Canada to confirm what this all means. Just for some background, the only reason I seeked testing for OSA was friends and family saying I made weird “choking” noises during sleep. I can honestly say that I functioned well even before the diagnosis. I felt slightly tired at times, but never dozed off or fell asleep on the job, driving or anywhere else. Ever. I function quite well at work. Pending seeing specialists to confirm if there’s anything else I can do to reduce the sleep apnea, I am on CPAP and have been told the tests confirm it is working and my sleep apnea has pretty much disappeared.

My question is, is it up to ME to determine if I am safe to work? It seems like it from this letter. When I reviewed that section of CARs it seems like the prohibition of exercising your privileges requires BOTH of:

-an illness or seeking treatment for an illness
AND
-it possibly affecting safely exercising your license

If someone could clarify, that would be great. The letter was super vague and Transport isn’t answering their phones so this would be a lot of help in the meantime.

Which region are you in? I had success emailing the TC office in Vancouver.
