The E2-B NIW Visa Thread
For discussion of obtaining E2-B visas for Canadian pilots looking to emigrate to the United States for employment as a pilot.
Re: The E2-B NIW Visa Thread
I'm starting to see more services like this being advertised. I'd love to hear from people that have been successful or are currently in the process about which lawyer/company they used.
Re: The E2-B NIW Visa Thread
Harvey Law was doing extremely well getting these visas. They are down to 70% success rate. The reality is that much of it depends on which immigration officer gets your file.
I know a couple people who have been given the green light by immigration and are now waiting months and months for the interview.
It is happening however. It just takes a loooong time to get through the process.

I self petitioned a month ago. If I get approved I will help other pilots with the process to save on law firm fees.

That's great Ash. Good luck in your petition! Could you please give a rough outline of the process?Ash Ketchum wrote: ↑Tue Oct 17, 2023 5:23 am I self petitioned a month ago. If I get approved I will help other pilots with the process to save on law firm fees.

Dont waste money, follow these 3 easy steps:
1) Fly down to Mexico, and cross the Texas border with everyone else flooding the border there.
2) ??
3) Profit

Re: The E2-B NIW Visa Thread
I’m curious as well. The law firm I used did a lot of research and had a lot of insight I would have. Self petitioning would take a ton of time and effort so good for you for putting in that much time and effort. Also doubly good on you for being willing to share that hard earned info with other.itsgrosswhatinet wrote: ↑Wed Oct 18, 2023 12:01 pmThat's great Ash. Good luck in your petition! Re: The E2-B NIW Visa Thread
I'll be in touch Ash, looking forward to hearing how it's going. It'll be a lot of waiting but good luck!
I posted this in another thread but might as well put it here as well if it becomes a reference thread;
Since 2021 the US has officially given eligibility to spouses and dependants of an L1 Visa. So if your spouse meets the criteria and can get hired in the US, you're automatically in.
The L1 specifically doesn't currently lead to naturalization but there are some stopgaps you can go through if the spouse runs into employment issues down the road. You can also petition to stay based on job history, etc or get your company to help out an existing employee. An immigration lawyer should be able to take care of it.
Good luck to everyone who's deciding to get on a globally competitive payscale instead of the little leagues.

Good luck. I remember a while ago you mentioned you had gone to the us to convert your ATPL. Thank you for helping pave the path for Canadian pilots!Ash Ketchum wrote: ↑Tue Oct 17, 2023 5:23 am I self petitioned a month ago. Re: The E2-B NIW Visa Thread
Just thinking outside of the box; could you go to the US via Australia? Like get a job in Australia and a PR there and get a much better chance of going to a US major?
Re: The E2-B NIW Visa Thread
Pretty sure you’d need to be an Australian citizen.
One other avenue though would be the diversity lottery if you have, or are eligible for citizenship in a country that is included in the diversity lottery program. I know one Canadian that was able to go that route.
Re: The E2-B NIW Visa Thread
That is an option, however you'd have to become citizen first and only then would you qualify for the respective Visa, which is NOT a green card and tied to an employer...
Re: The E2-B NIW Visa Thread
Looks like it's only 4 years to become an Australian citizen.

Does Australia even sponsor Canadian pilots? All the job ads from there say that you have to have the right to work in Australia.

Re: The E2-B NIW Visa Thread
I get emails from agencies every month or two with Australia job offers that state they will sponsor your visa.
I'm more interested in a brief overview of the E2-B process if you could please share your experience.

I would love to know what Qantas pays their pilots. I have always been curious because Australia is the closest comparative country to Canada in terms of population, economy, geography, etc.
I bet they have no trouble paying more than AC…..

You need to have been born in the country you are applying from. I have an eu passport, but since I was born in Canada I don’t qualify. However, a lot of Canadians are born abroad so a good option for sure!Stinky wrote: ↑Mon Oct 23, 2023 12:33 pmPretty sure you’d need to be an Australian citizen.

Nah, Skytrans is even willing to sponsor Dash-8 FO's these days. Their only requirement is 500 hours.Ash Ketchum wrote: ↑Mon Oct 30, 2023 4:39 pm

I just sign up for the expat recruitment agency email lists. That particular offer came from Rishworth Aviation. Longreach Aviation, and CReW are also good ones.Ash Ketchum wrote: ↑Tue Oct 31, 2023 9:51 amThanks, I may look into this if my EB-2 NIW gets denied. Re: The E2-B NIW Visa Thread
My personal opinion is that US moving to the US is basically an hour trip, you're in the same time zone as your friends/family and can see them with a short flight, the Australians give up a lot more to move so it won't be used as much, hence why there wouldn't be nearly as much push back (for both governments)
