Gotta wonder about an organisation that can't even afford to develop it's own website, but would rather poach someone else's work. Not sure I'd want to have anything to do with them, except maybe in a court of law...

To the owners of Maylan: The guy who built our website (an honest, hard working pilot, BTW) happened to come in today, is pissed off, and has downloaded all the pages. You'll be hearing from us shortly.

Well, they don't look all that similar to me, but good luck with your legal action all the same. You should, however, have a look at your spelling. They will take you more seriously if you spell imitation with one "m".

I wouldn't get too hot about it. That other website is hard to read and very unprofessional. Comparing the two is night and day.

Still, plagerism isn't cool. But it looks more like a test page to me.

I'm cool as a cuke (thanks for the spell-check, though servo- how would I manage without you? ), but the guy who actually built the site, took the photos, and spent hours developing the copy isn't really happy. He feels that Maylan Aviation should compensate him to the same amount we did, and I happen to think he's right.

As for similarities, the sites are pretty much EXACTLY the same, with the exception of the background. Some content (re: prices, etc) has been deleted, but the photos are all ours, the hangars are ours, etc., etc. If you look under the Charter section, you can even see a reference to Juanair that our IT dep't missed during the changeover.

I decided to post this here, because I think if you demonstrate poor ethical standards as Maylan Aviation has, you should be outed. What better place to out someone than here at Avcanada?

Robin is making reference to this site: http://www.mlfa.ca/ under Flight training.They are identical. Check the Charter section, they even forgot to take the old "Juan Air" name out.

Plagiarizing another schools website?!?! Well that’s professional. Welcome to Chinada boys and girls; it’s only a crime if you get caught.

Mr. J did his Chinese – Canadian license conversion at the Vlictolia Frying Crub a few years back when I worked there. Robin, talk to GP he can confirm; DJ was talking about the Flight Training idea back then, copying your website was no accident.

BTW, there have been some good precedents set forth in Canada for copying websites.

IANAL, but its actually pretty straightforward infringement. You probably have two cases. One for the website copy (HTML) and a second for the photographs. Standard damages for unauthorized use of photographs or artwork in a commercial environment is triple damages. So if you originally charge $200 per photo you can easily recover $600 per photo from the infringer. The site is more complicated but we have recovered successfully from a few infringers without even proceeding to litigation since our case was strong.
Spend the money and get an IP lawyer involved now if you are really interested in going after this. They can give good guidance on valuing the work and on what evidence you should preserve.

One of the nice things about working for a very large, deep-pocketed company is that you have resources when something like this happens. First thing I did was call our IT dep't and have them download ALL the pages for use as evidence, as I figured once I'd posted here, they would begin to disappear. That part is done. Next call was to Legal, whose opinion (like mine) was a cease and desist letter, accompanied with an estimate of what the amount owing to our web-builder would be. That is to come.

I would have called them myself, but I can't find a phone #, and i didn't really think a request like this was appropriate for e-mail medium. .

At this point, DJ, removal of the site, and an appology to myself and a case of beer to the designer would be sufficient. Feel free to call me.

I got a good laugh when I saw Maylan's letter head. A bar across the top reads
"MAINTENANCE, MANUFACTURING, REPAIR, OVERHAUL, TRAINING"
