WINNIPEG — A man who believed he was following God's orders when he stabbed and beheaded a fellow passenger on a Greyhound bus in Manitoba has been found not criminally responsible, devastating the victim's loved ones.

Justice John Scurfield said Vince Li's attack on Tim McLean last summer was “barbaric,” but the law makes allowances for those with severe mental illnesses.

“These grotesque acts are appalling,” Justice Scurfield said Thursday. “However, the acts themselves and the context in which they were committed are strongly suggestive of a mental disorder.

“He did not appreciate the act he committed was morally wrong. He believed he was acting in self defence and that he had been commanded by God to do so.”

Both Crown and defence psychiatrists had testified at Mr. Li's trial that he was suffering from schizophrenia and believed God wanted him to kill Mr. McLean because the young man was a force of evil.

Mr. Li, 40, was charged with second-degree murder but pleaded not guilty. His DNA will be put on file but he won't have a criminal record.

He is to appear before a criminal review board within 90 days to determine how he will be institutionalized. His mental health will be reviewed every year to determine if he can be released into the community.

“That does not mean that he should go free,” Justice Scurfield said in his decision. “The public needs to know that when a person is found not criminally responsible, it does not automatically follow that a person will be released into the community ... People who are found not criminally responsible but who continue to pose a danger to the community may be kept in a locked institution for the rest of their lives.”

That was cold comfort to Mr. McLean's mother, Carol deDelley.

Mr. Li may be mentally ill, but the fact remains that he killed her son in the most brutal possible way, she said.

“He still did it,” she told reporters outside court. “Whether he was in his right frame of mind or not, he still did the act. There was nobody else on that bus holding a knife slicing up my child. Nobody else did that. Just one individual did that.”

Ms. deDelley said will fall to the family to attend Mr. Li's annual reviews and try to ensure he never be allowed on the streets again. The law needs to be changed so someone can be found not psychologically accountable but still criminally responsible for a crime, she said.

She also took a shot at Canadian immigration policies which she said allowed Mr. Li, who was born in China, into the country with a mental illness in the first place.

But both Crown prosecutors and Mr. Li's defence lawyers said justice was done.

“The evidence was so overwhelming that he was not criminally responsible,” said Crown lawyer Joyce Dalmyn. “I had an obligation to bring that to the court's attention and the family understand and respect that.”

The review board will do its job “properly” in determining if Mr. Li is ever fit for release, she added.

Such boards look at police reports and transcripts of previous judicial hearings and also hear evidence from treating psychiatrists, who testify about a patient's current mental condition, treatment and prognosis. Crown and defence lawyers get the opportunity to ask questions.

The board must carefully consider whether a patient could function in society or would pose a risk to the public. Members take into account a patient's insight into the illness as well as into what happened.

“Mr. Li will get help,” said his lawyer, Alan Libman. “The Canadian public can be assured that the review board will take into consideration the protection of the public. Mr. Li advised me after court that he's going to work with his treatment team because it's his desire to get better.”

Justice Scurfield's decision brings an end to a trial that lasted barely two days and only heard from the two psychiatrists, both of whom testified that Mr. Li is mentally ill and didn't realize killing Mr. McLean was wrong.

Mr. McLean's family dismissed the trial as a “rubber stamp” that allowed Mr. Li to get away with murder. They are vowing to turn their attention to fighting the law that allows people who are found not criminally responsible to be released once they are deemed well, without serving a minimum sentence in jail.

That Mr. Li killed the 22-year-old carnival worker — brutally stabbing him dozens of times, beheading him and then mutilating his body — was never in question at the trial.

An agreed statement of facts read in court detailed how Mr. Li sat next to Mr. McLean after he gave him a smile and asked how he was doing. It was after Mr. McLean closed his eyes to listen to music on his headphones that Mr. Li said he heard the voice of God.

“Suddenly the sunshine came in the bus and the voice said, 'Quick. Hurry up. Kill him and then you'll be safe,”' Mr. Li told one of his psychiatrists. “It was so quick, such an angry voice, and I had to do what it said. I was told that if I didn't listen to the voice, I would die immediately.”

Mr. Li ignored other horrified passengers as he repeatedly stabbed the young man, who unsuccessfully fought for his life.

When the bus pulled over near Portage la Prairie, Man., Mr. Li was engrossed with stabbing and mutilating Mr. McLean's body. Passengers fled the bus and stood outside.

Mr. Li tried numerous times to leave the vehicle but was locked inside and continued methodically carving up Mr. McLean's body. Police said body parts were found throughout the bus in plastic bags, although part of his heart and both eyes were never found and were presumed to have been eaten by Mr. Li.

The victim's ear, nose and tongue were found in Mr. Li's pocket.

God told him to cut up Mr. McLean and scatter his body parts around the bus, Mr. Li said.

“God told me to do it. Otherwise it would come back to life very quick and kill me. So I cut it up to make sure he couldn't come back to life ... God told me to cut off his head, so I did.”

Mr. Li tried to escape from the bus through a window and was taken into custody.

After that, with blood smeared on his face from the attack, he politely apologized to police and pleaded with officers to take his life."

So, pick up a stapler in a threatening manner and you get death by cop, behead a guy, mutilate the corps in front of the cops, ask them to kill you, and they nicely arrest you, send you to court where they call you insane and try to get you help?

The moral, small crimes are met with excessive force, if you're gonna be bad, go all the way or go home.

Kinda like the ol, rob the convenience store, get the chair, steal billions from shareholders and get house arrest?

The guy was obviously mentally incompetent and will be institutionalized for life. He's not going anywhere anytime soon.

The most difficult thing about flying is knowing when to say no.

After over a half a century of flying I can not remember even one trip that I refused to do that resulted in someone getting killed because of my decision not to fly.

In my limited study of law...

In order for an actus reus to be committed there has to have been an act. (guilty)

Mens rea is the guilty intention, and here they simply say he was lacking a guilty intention as he was not of a reasonable mind. So, in our way of law... the verdict does make sense on paper.

Logically speaking however, if he isn't mentally capable of understanding his actions he will forever be a danger on society and should never be free again. Why waste our resources locking him up forever, give him what he wants anyhow, death. Can we really justify the
$60 000/year (or about how much it was last I heard) to keep him locked up? That $60k could sure help out a lot at the local children hospital. Hell, if we have to waste the money isn't that about 20 406ELTs per year? I digress, but with the guilty action so obvious and witnessed by so many, we need a better solution then to pay his room and board as well as therapy with highly trained (read:expensive) professional shrinks?

Another question, if common sense is so rare... why do we call it 'common'?

I think the next time he's allowed to take public transportation he should be seated between a judge and a lawyer, just in case the voices come back.

Not guilty by reason of insanity goes much deeper than a lack of mens rea. (intent, in addition to Actus Reus: the criminal act)

Just because he is found "insane," which is extremely hard to do in criminal cases, he will also be safeguarded from the public for most likely more time than if he was found guilty of murder.
If the end result is to keep this man from committing more crimes to the public, justice was served.

He has a chronic illness. A vital organ in his body isn't working properly and he needs medical treatment as a result. When the brain is afflicted with paranoid schizophrenia the sick person can experience hearing voices and seeing hallucinations. In a handful of cases, unfortunately, those voices and hallucinations can come in the form God or some other demonic creature giving them orders to harm other people.

Some people take the view that he should be punished with execution or life in prison because his medical condition caused him to commit homicide. Would you have the same opinion for somebody who had a heart attack (and survived) while driving their and as a result ran someone down and killed them? It's no different.

But I'd take away their licence for public safety. They won't hurt any one while walking. This guy can kill with any weapon.

There has always been a debate around the insanity defence. Perhaps it would be better to change the available plea from "Not guilty by reason of insanity" to "Guilty but insane". Entering the later plea would result in automatically being placed, for life, in a mental hospital. It serves most people's purposes; you are not punishing the accused (mental hospital vice prison) and you are getting him out of society so he can't do anymore harm.
I'm wondering what would have happened if it had been a white guy getting off for beheading a member of a minority?

No.....the system that I am proposing recognizes that this sort of thing can't be cured, and as such does not allow the shrink to release the guy. He spends his life in custody.

But that is not the system we have and I think that's to a large extent why many people are unsatisfied with the decision. A sentence of 'life in prison' does not mean a criminal will never be released. Child pornographers are jailed and released even though it's known they cannot (or refuse to) stop wanting to have sex with underage kids. 'Institutionalized for life' doesn't mean a nutcase won't be released when some quack psychologist decides "he hasn't done any harm in the last ten years, so he must be cured". How are we to know for sure that this guy, who has already proven once that he randomly kills, will not be released 10 years from now after he 'recovers', and then go on another bus trip and behead/stab/bite/eat to death another unsuspecting person?

Having a standard that pilots lose their licence after making a mistake despite doing no harm to aircraft or passengers means soon you needn't worry about a pilot surplus or pilots offering to fly for free. Where do you get your experience from?

I propose that such people are criminally responsible for the actions of their patients. He gets released and kills somebody, psychiatrist goes to jail.
