Minimum rest period

Was searching the CARs site and didn't find much about the minimum rest period. They keep talking about it but they don't definine it. I'm looking for the part where they say you can't be disrupted by your boss during your minimum rest.


And the question following that is: What if he does? Some say you can restart your rest from the begining but i never read anything about it.

"minimum rest period" - means a period during which a flight crew member is free from all duties, is not interrupted by the air operator or private operator, and is provided with an opportunity to obtain not less than eight consecutive hours of sleep in suitable accommodation, time to travel to and from that accommodation and time for personal hygiene and meals; (période de repos minimale)

And they're not going to. TC says what the regulation is and how to comply with it and that's all. They will not get into hypothetical situations.

But notice the words "is not interrupted". If an operator interrupts your rest period they are not complying with the regulation, so what you do next is up to you. But you have the regulation on your side in black and white.

Reminds me of the 9 hour dispatch time a large well respected YYC 703/4 company uses on back to back 14 hour duty days. I explained that it took me half an hour to get home half an hour to get back so when would you like me to eat and shower? That's not our problem they said. Move closer.

You need to turn of your phone when you go to sleep. They can't fault you for it.

Getting called, emailed etc during any rest period from a company means that the rest period starts again IMHO

In my opinion as well. Didn't make dispatch too happy the last time I was in that situation though.

To the OP: Check your COM, it should all be spelled out there. The regs are only the bare minimum and there may be more limiting rules in your COM. I know mine says interrupted rest means start over at least, yours probably does too...

There is also a split duty day where you need 9 hours of rest but split it into 5 and 4 hour periods. I did it for 2 weeks and didn't mind it.

Emailed? Are you guys out of your minds? How on earth would an email interrupt your rest period?

If your paystub shows up in the mail does that reset your rest period as well? If anyone at my operation showed a lack of judgement like this it would be their severance check they'd be getting. Bye.

I think your getting confused with splitting a duty day, even after you do that you still need to get 8 hours of UNinterrupted rest
